These Terms of Use ("Terms") govern your use of the Last Photo iOS application ("the App"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
Last Photo is a personal photo-awareness tool. It analyzes your photo library on your device to show how long it has been since your last photo with people you choose to track. It is provided for personal, non-commercial use.
The App does not upload, transmit, store, or access your photos on any server. All analysis happens locally on your device. You retain all rights to your photos. We never see them.
Face grouping, day counters, photo matching, and place detection are automated, on-device estimates and may be incomplete or incorrect. The App may mis-identify people, miss photos, or show inaccurate dates or places. You are responsible for verifying any information before relying on it. The App is not a backup tool, an archival service, or a system of record.
The App displays information about personal relationships, including memorial features for deceased loved ones. It is provided as a gentle personal tool and is not medical, psychological, or grief-counseling advice. If you are struggling, please seek support from a qualified professional.
Optional "Last Photo Pro" features are sold through Apple as auto-renewing subscriptions (yearly at US $19.99/year with a 7-day free trial, or monthly at US $2.99/month; prices vary by region) or as a one-time lifetime purchase. Payment is charged to your Apple Account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple Account settings. Free-trial time, if unused, is forfeited when you purchase. All billing, cancellation, and refunds are handled by Apple under Apple's terms.
You agree to use the App only with photo libraries you lawfully control, and to respect the privacy rights of people appearing in your photos. You must not use the App to harass, stalk, surveil, or harm any person, or in violation of any applicable law.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DATA DISPLAYED WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PHOTOS, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR TEN US DOLLARS (US $10), WHICHEVER IS GREATER. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.
You agree to indemnify and hold the developer harmless from claims arising out of your misuse of the App or violation of these Terms.
We may update the App and these Terms; the current Terms will always be posted at this address with an updated date. Continued use after changes means acceptance. We may discontinue the App at any time; because all data is stored on your device, discontinuation does not delete your data.
These Terms are between you and the developer, not Apple. Apple has no obligation to provide support for the App and is not responsible for any claims relating to it. Apple's standard Licensed Application End User License Agreement applies where not superseded by these Terms.
These Terms are governed by the laws of the jurisdiction in which the developer resides, without regard to conflict-of-law rules. Disputes shall be resolved in the courts of that jurisdiction, unless mandatory consumer law in your country of residence provides otherwise.
