PetPal - Terms of Service

Please read these Terms of Service ("Terms") carefully before using the PetPal application ("App"). By downloading, installing, or using PetPal, you agree to be bound by these Terms.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and PetPal ("we", "us", "our"). By using the App, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms.

2. Description of Service

PetPal is a pet care management application that allows users to log care activities, set reminders, store veterinary documents, and coordinate care with household members. The App includes both free and premium ("PetPal Pro") subscription tiers.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. In-App Purchases and Subscriptions

• PetPal Pro is available as a monthly or annual auto-renewing subscription.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You may manage or cancel your subscription at any time via your Apple ID account settings.
• No refunds are provided for partial subscription periods, except as required by applicable law.
• All purchases are subject to Apple's App Store Terms of Service.

5. No Medical or Veterinary Advice

IMPORTANT: PetPal is a care-tracking tool only. The App does not provide veterinary, medical, or professional animal health advice. Nothing in the App should be construed as a substitute for professional veterinary consultation. Always consult a licensed veterinarian for any health concerns about your pet. We are not liable for any harm to your pet arising from reliance on information in the App.

6. User Content

• You retain ownership of all content you create within the App.
• You grant us a limited, non-exclusive license to store and transmit your content solely for providing the App's services.
• You are solely responsible for the accuracy and legality of content you upload.
• You must not upload content that is illegal, harmful, or infringes on intellectual property rights.

7. Acceptable Use

You agree not to: use the App for any unlawful purpose; attempt to reverse engineer or decompile any portion of the App; interfere with the App or its servers; circumvent any security measures; or use the App to transmit spam or malware.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR HARM TO YOUR PET. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless PetPal and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the App or violation of these Terms.

11. Privacy

Your use of the App is governed by our Privacy Policy, incorporated into these Terms by reference.

12. Intellectual Property

The App, including its design, code, content, logos, and trademarks, is owned by PetPal and protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the App without our prior written consent.

13. Third-Party Services

The App integrates third-party services including Firebase, RevenueCat, and Apple Sign In. Your use of those services is subject to their respective terms and privacy policies.

14. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any violation of these Terms. Upon termination, your right to use the App ceases immediately.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, USA. Any dispute shall be resolved through binding arbitration under American Arbitration Association rules. You waive any right to a jury trial or to participate in a class action lawsuit.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Continued use of the App constitutes acceptance of the revised Terms.
